The protection of intellectual property and the use of materials own by other businesses is a major challenge for businesses. This poses as an ethical issue for organizations and businesses. Digitalization with time has change the trend of us paying people for services they provide. Rather, people now have access to other people property without their content through the internet. People for example assume that music from website belongs to no one, forgetting that it was created by somebody. However, this intellectual properties are the valuable properties of one’s business and; it is possible for intellectual properties to be among the most important asset that is possessed by the business (Buchanan & Wilson, 2014). Thus, it is important to protect your intellectual properties as they can distinguish your business from the competitors' businesses. Also, intellectual property can be easily sold thus providing a significant revenue source, they offer something new and different to customers, and intellectual properties can be used as security for loans (Randau & Medinskaya, 2015). From the listed advantages we can conclude that intellectual properties are valuables. Thus, they need excellent protection.
A good case to describe my reasons for protection of intellectual properties is about Apple Company. Apple has been protected against manipulation and illegal copyrighting by their counterparts. Since it is unlawful to duplicate Apple’s success, Motorola and Nokia don’t use iSuppli bill of materials to make their iPhones (Randau & Medinskaya, 2015). Also, protecting intellectual property protects an individual from exploitation through strategic alliances. For instance, the law protects Apple intellectual property against infringement by Nokia or Motorola.
After establishing your intellectual property, it will be good to safeguard it. There are several ways of protecting the intellectual properties as follows. One thing that can be done to protect intellectual property is registering the appropriate Intellectual Property protection (Randau & Medinskaya, 2015). This is done through trademark registration, which legitimizes an individual or a company's rights to use a particular symbol. Also, under property registration is the registration of copyright. This gives the property owner the rights to sue anyone found using his or her property without permission (Buchanan & Wilson, 2014). Additionally, intellectual property can be protected by keeping silent. Intellectual properties can be valuable ideas that can be stolen when exposed to a second party. Thus, it is essential for the owner of the concept to maintain silence.
Intellectual property protection has gone too far. This can be evident when an individual company claims to own copyright over their products. For instance, it is possible for a company to have stopped producing specific products for even more than 20 years, but when another company produces the same goods, the first company can sue it (Randau & Medinskaya, 2015). The fact that the first company no longer produces the product does not mean that they do not own the copyright to it. The ownership of copyright is based on the fact that the worker for the first company was the first one to produce the good under the first company’s name.
A proper balance between content producers and intellectual property ensures that intellectual protections do not go beyond their boundaries. People safeguard their intellectual properties through many ways, but the balance ensures that the intellectual property that can have a negative impact on the public is controlled (Randau & Medinskaya, 2015). An example of the intellectual property that can negatively influence the public is pornographic content, violence, and drugs.
